Terms of use
The agreement between you and Darkmode Ltd covering your use of Visionary. Plain language, and short.
Agreement
Visionary (“the app”) is published by Darkmode Ltd (“we”, “us”). By downloading or using the app you agree to these terms. If you do not agree to them, please do not use the app.
Your use of the app is also subject to Apple’s Licensed Application End User License Agreement ↗, which applies to every app distributed through the App Store. Where these terms and Apple’s conflict, Apple’s prevail.
What you get
Visionary is unlocked by a single in-app purchase of $9.99. It is a one-time payment, not a subscription: nothing recurs, and nothing is charged again.
The purchase grants you a personal, non-transferable licence to use the app on devices signed in to your Apple ID, for as long as the app remains available. It is tied to your Apple ID rather than to an account with us, which is why there is no password to lose.
If you reinstall the app or move to a new device, use Restore Purchase on the unlock screen. You will not be charged again.
Payment and refunds
Payment is taken by Apple through the App Store, not by us. We never see or hold your payment details.
Refunds are handled by Apple, not by us. We have no ability to issue, approve or refuse one. To request a refund, visit reportaproblem.apple.com ↗ and follow Apple’s process. If a refund is granted, access to the app ends.
Statutory rights you may have as a consumer — including any right to cancel a digital purchase under UK or EU consumer law — are unaffected by anything in these terms.
Your content
The photographs, boards and everything else you make in Visionary are yours. We claim no ownership of them and no licence over them, and since they never leave your device we have no access to them.
You are responsible for having the right to use the images you add. Do not use the app with images you do not have permission to use.
Your content is not backed up by us. It lives on your device. If you delete the app, lose your device, or restore it without a backup, that content is gone and we cannot recover it. Keep a device backup if it matters to you.
Acceptable use
Please do not:
- Copy, decompile, reverse-engineer or attempt to extract the source code of the app, except where law expressly permits it.
- Resell, rent or redistribute the app or your licence to it.
- Use the app to create or store material that is unlawful, or that infringes someone else’s rights.
- Attempt to circumvent the purchase, or to access paid features without paying for them.
Our intellectual property
The app, its name, its design and its code remain the property of Darkmode Ltd. Your purchase buys a licence to use it, not ownership of it. Typefaces bundled in the app are used under their respective licences and remain the property of their foundries.
Availability and changes
We may update the app, change how features work, or stop distributing it altogether. We will not remotely disable an app you have already paid for, but we cannot guarantee it will remain available for download or that it will keep working on future versions of iOS.
These terms may change. Material changes will be reflected here with a new date at the top of the page, and continuing to use the app after that means you accept them.
Disclaimer and liability
The app is provided “as is”. To the fullest extent the law allows, we exclude implied warranties and do not promise that the app will be uninterrupted or error-free.
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our total liability to you is limited to the amount you paid for the app.
Visionary is a tool for arranging pictures. It is not advice of any kind, and no outcome is promised by using it.
Governing law
These terms are governed by the laws of England and Wales, and its courts have jurisdiction over any dispute. If you are a consumer, you keep the benefit of any mandatory protections of the country where you live.
Apple
Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
